I agree with Anders. The OP asked a specific question and thanks to those who have answered it. It's an important issue so perhaps someone can start a new, more general thread for our future reference.
My own advice (as I am not an expert) is to listen to those who make and sell guitars, having dealt with CITES and the related paperwork.

Back on topic and just to sum up my experiences.
When I sell a guitar to the USA: *I´m obliged to make a signed invoice 3 copies with a description of the article (flamenco guitar) and why its being exported to the USA (sale) *I´m obliged to fill the Lacey act papers with the correct description of the wood. Doesnt matter what kind of wood. *I´m obliged to have CITES papers if I´m using endangered species. This has not been a problem yet because I dont use woods like Braz rosewood.
I once forgot to fill the lacey act papers and the guitar just stopped in Spanish costum until I had done so.
Judge yourselves what has happened in this case. If the maker/seller has acted according to laws. I think I have made it clear what I think of this subject and what I belive could/should be done. Its out of my hands to do anymore. And I´m not a specialist, I just follow orders.

I will be waiting on the documents sometime this week. If I am not satisfied (meaning if it is not CITES documents) I will be returning the guitar. I underestimated how big deal this issue is and though I do love the guitar itself, I think it is not worth taking the big risk to go overseas with it

When importing a guitar to the US you have to file the PPQ 505 for the US Dept. of Agriculture. It can be filed electronically or downloaded and a copy can accompany the guitar. It's best to do both, file it electronically and include a copy of the form in the packing list with the invoices.
This form tells the US Dept. of Agriculture which species are entering the country, it's easy to fill out, but a detail that can't be overlooked.

Neotriz make him fill out the Lacey act papers, CITES (or other proof) and invoice!! (all of it because thats the game).
That way, if something happens, then you can blame him.... If he doesnt want to do that, then its an illegal sale. And you can then proceede from there.
