kehati--when you clicked the "buy it now" icon you were sent to second step, that being "confirm to buy". if you did not click that icon how did you get out of buying the guitar? at the point there are two options. one options gets you out of the process and the other option results in a sale--which i think happened as it appears you bought the guitar (hence your need to send the seller a letter wanting to get out of the deal).
i think the best solution is to be upfront with what happened--to the forum and to the seller. you might be able to get out of this situation with minimal cost or you might have that guitar you wanted. it seems very improbable that you got out of the buy it now sale and then the seller decided to send the guitar without money exchanging hands.
Rest your minds guys, be positive. If you dont like it, leave it.What I feel, is all about other people enjoying bullying people with words..
when you are offered solutions (which you are supposed to know), you dont seem to take them and end the story, instead you continue to whine and make a whole drama story.
and whats worse is that, when you get honest feedback from people of what they think of what you are saying, you play down the "good-intention-poor-guy card" and then you accuse us (who dont like this thread) of bullying you?? WTF??
it sounds like as if someone holding knives ,stabbing himself, and crying for help and complaining, and then when he is offered help and people try to stop him, he refuses help and continues to stab himself. its just a waste of everyone's time, seriously.
by the way, im not going to tell you what to do, but please STOP making provoking long ass topic titles!! PLEASE! just look at how i changed it, few words and simple? why cant you do something like that? and why out of all the many replies you get here, you IGNORE A LOT of them and you only reply with a few words to a few of them???
also please don't be lazy to use the spell check on in your web browser when you write, English not being your first language is not an excuse for that.
regarding your 2 previous threads you had a reply from someone saying this:
quote:
Hi, I have bought a couple of guitars from this guy to keep on my boat. I think they are Chinese but nevertheless they are great for the money, and sound surprisingly good You probably got a message that your guitar is packed & ready to ship, He will not ship it until he has your shipping address & payment. You should send him a message requesting to cancel your order. No problem
AND YOU IGNORED THAT!!
also in your looking for guitar topic, YOU IGNORED ALL THE DECENT GUITARS PEOPLE OFFERED YOU WITHIN THE PRICE RANGE YOU ASKED FOR! AND INSTEAD GOT THIS GUITAR NO ONE HEARD OF!
RE: You know what? The E bay guitar t... (in reply to Guest)
wow i cant believe it was real..
you are a good man for doing the decent thing, i knew you would, otherwise you would have kept all this secret and not have made it public from the start

ORIGINAL: Pgh_flamenco It's my understanding of eBay's policy. People are free to do as they wish when completing a transaction. A protocol is necessary because when things don't work out either person might appeal to a third party for assistance. This isn't the same as a face-to-face sale where the buyer can evaluate the item in person.
Ebay IS face to face sale. You pay ebay % for the service of offering a market, you dont pay them for the item. It remains a contract between you and the seller[edit: i realized i misinterpreted you in that point. still, the reason why in BtoC the consumer usually pays in advance is not because of evaluating. Most goods cannot be evaluated ad hoc anyways. In Germany at least it used to be normal to pay afterwards. Only in the last years it changed). I had a look at ebay's policy. I nowhere could find a "rule" implying that ALL items must be paid in advance. The only passage i found is:
"Im Allgemeinen empfehlen wir, dass Sie innerhalb von 4 Tagen nach dem Kauf den Artikel bezahlen. Einige Verkäufer geben in ihren Angeboten an, wann der Artikel bezahlt werden soll."
Which translates to: "We suggest you to pay within 4 days. Some sellers mention a deadline in which you should pay the item." Before that passage there was written: "Most sellers ship the item after receiving the payment.", which again proves my point of there not being a strict rule.
Stick to the law and written text, dont interpret it and dont change it to something else only because of habits. I mention this because in the past i had posted some legal questions in forums, and received all kinds of wrong answers which left me at disadvantage. People were bulshitting, contradicting the actual law (which i found out afterwards). My advice is, if you dont have a lawyer at hand, inform yourself and dont post it in forums. This can be also understood as a message to kehati.

You said earlier
1. did I click the "buy it now" icon? - YES
2. did I click the "confirm to buy" icon? - NO
Therefore: No purchase was recorded Therefore: He is unaware that you hit "buy it now"
Then you said he shipped it to you. Did you , for some strange reason give him your address? He doesn't get your address unless you compete the purchase.

I, for one, am sick of reading about Kehati and all his problems: His middle-age decision to remain unemployed, his wife, his living off his parents, his chagrin at his parents for not financing his desire to live in Spain, his half-assed melodrama regarding eBay and the guitar.
To paraphrase Henry II's plea regarding Beckett, "Will no one rid us of this meddlesome thread?!"
