THE END FOR SHARING TAB FILES???!!! 

Guys, I came across this article recently through a link on my favorite powertab website www.powertabs.net - the main powertab download website on the net.

The website said that due to this "legal action" they were no longer allowing the distribution of tabs through their website.

I think this is a shame, as the websites were a good resource for amature guitarists, especially when no official tab book is available.

Is this the end for sharing tab files???!!!

This is stupid! These days there is a "legal action" for everything. In North America some people eat like pigs and they take legal action against the fast food companies for making them fat! As far as tabs are concerned, they are tabber's "interpretation" of the copyrighted songs and may not necessarily fall into the protected copyright catagory, if challenged in court. There are always loop holes around these stupid laws.

BTW, I checked "mysongbook.com" which also has tons of tabs and it seems to be operating as usual.

hmm , Flo .... maybe u're right Flo , he's not doing it for free...but still ,he is very
generous with what he knows ....he could have just teach a little falseta ,and play
some of his compositions ...and end and say that's all folks.
I very much like him ... I feel like he's sincere when he says at the end ..."and
stay aficionado ".I mean ....I wont compare other encuentro's cause maybe
they are like that, cause the player maybe doesnt like to teach or he doesnt know.
But still ...I understand that these should be didactical in a way .It says so in
every book .They wanna demonstrate that "flamenco can be learned from books also"
if u are the right reader(Every book opens with denying this "el flamenco no se aprende
in libras").
I dont know about flamenco videos ...but I watched some rock guitar video pretty useless
, like the guy shows up ..and play like hell ...and then say , now u try it .

My point is Nunez didnt have to do it , to show it all ....he could have just played some
of his compostions and say bye.I imagine for him it would have been quite easy just
to show off, and just for that showoff ...he would have been colecting the money.
So I like him ...cause he's giving u a hand ,like he knows u play bad and he wants to help u.It's rare to find a good teacher like that.

I see it from both sides of the coin.
Everything I have ever uploaded...(although it's always been a link to my own ISP site, so I am ultimately responsible, not this Foro), has always been in the interest of the Artist....to let folk hear something they'd never consider buying...or maybe a clip of a famous guitarist off UK TV that they would never have heard before.
I'm sure the artists concerned would have no truck with that, but as been said in an above post that there are many smarmy lawyers, fresh out of school and chompin' at the bit to make a name for themselves.
"File Sharing", such as (the old) Napster etc, was not only illegal, but immoral IMO.
Everyone has a right to be paid for their creations, ideas, or services if it provides pleasure or benefit to the recipient thereof.

Like the Supermarkets sucking the farmers dry and making them grow crap food at a predetermined low price, we need an introduction of the old "market economy", where
if you had a little shop, or an idea that stimulated people, then you could make a basic living.
The present plan of huge Multi-nationals treading upon the local shops and putting them out of business, while they pay their individual Directors tens of millions of pounds yearly bonuses is frankly the road to destruction IMO.

I agree with you, i am not saying hes not generous i was just saying that he was getting paid for encuentro.

But u right, i have heard from many people that hes quite generous

For me this disscution is like this.

Teaching it all is kind of a nobile idea and this is a service that u can return to
music ....and who knows because of you ,flamenco will grow ...and new players
will arise and grant a tribute to you...and that's good.

I also understand the other one , who say ...hey , i worked hard for this
please give me the price i'm asking cause I know i deserve it.

I think that u cant be just in a way , u have to live also ...and that's correct.
But comparing some gipsy that has no money and Metallica ...well ,maybe
I'm too used to see the bad in people...maybe Metallica was in just for
the principle and not for the money....but I dont believe it.

Anyway, I'm not thinking just in a way ...i understand i think both sides,
but i'm afraid that they had that position cause of some manager
that said "u know , u are top download in napster,just think of all the
money u could have".I dont contest their position towards naspter,
i just dont like their motivation for having this position.
It's like i dont like machiavelli's saying " the purpose ,justify any means".

I dont know ...this is hard to talk about it , things ...are just the way they are.
Maybe were overdoing this morale thing ...u could end up and believe
that it's imoral to watch tv and eat popcorn...while a kid is starving in Africa.
In the end ..everybody is on his own,and that is the most natural thing
so u cant stop beeing like that(for example i cant stop thinking at chicks )
Morale is smth u learn and is not smth natural.I can trust myself I will do
always the morale thing....they are times when I'll kill for a cigarette :D.
Btw,has someone seen Dogville and Manderlay (just asking).

Well ,things are....not gonna resolve very soon ...
When I was in highschool ...i had to take this exam about Plato(we call
him Platon).He has this morale issues in one of his books...u know the one
with the ring?

Ok,internet ...is almost like having a Gyges ring, u are almost invisible....this issue
is first found in Plato....I find it hard to believe that Metallica is interested in philosophy.
That is my point (hey this posting is cool ...Plato and Jesus in the same post

In a way , if u want we all posess the Gyges ring ....as our ego (call it soul or what u want)
still remains a mistery for the others.I may think i know u ,but probably I dont .

ok,to conclude Plato brings this issue in a way of our unseen souls ....Jesus gives

could go for ever,and that's probably why this story is told in schools since Plato.

It's copyright, and I think it's 70 years in the US. That's why there are so many irrelevant Shakespeare, D-i-c-k-ens, Stoker, Jane Austen and Thomas Hardy (aaah!) movies/tv dramas - no script royalty fees.

Sorin,
I was referring to the posts I made about Paco in Edinburgh.
I also saw Gerardo a few months earlier.
What I respect about Gerardo is his love of teaching and passing on the knowledge to others.
As a top player he doesn't have to do that to make ends meet financially.
I doubt if Tomatito, Gerardo or Moraito make heaps of money from their "Encuentro" stuff.
Whereas I feel Paco quite enjoys maintaining his "mystique" and prefers to "give something back" to his fans by signing labels to stick inside Carrillo guitars.

As for the other stuff, I wasn't being cryptic or anything.
I was just stating that I don't think it is fair for someone to take the fruits of someone elses labour and distribute it to the world for free, if the person who created it depends on the income from that work to continue.
It just discourages innovation.
However on the other hand I hate when big multinationals descend on a small thriving economy and push everybody out of business, replacing home grown products with stuff flown in from all over the world and replacing the friendly chat with the fishmonger or greengrocer with a "shopping experience" and "Have a nice day".

I'm in a particulary grumpy mood these days as I'm having to deal with an insurance
Customer "Care" Call Centre, where not only is the phone system automated, but the bloody person you talk to is too.

thanks Ron ,I am going to read the post u mentioned ...it's true I dont really read the
discussions in the flamenco events usually.
I think ...i'm not that cheerful these , i missed some carroling acompaniament cause of
my temper ....and I hate when holidays are closing in ,cause I have to get all my stuff,
computer cds,dvd ...and head home for two weeks.I like the holidays, hate cleaning carpets
and dusting though (we here, have like a ritual cleaning when Christmas and easter
are coming ...it is suposed to clean our houses and our souls, so that the spirit of
the holidays should find us as better human beings.I think we exagerate on dusting ).
Got to get going ...in have an hour ,my folks are gonna be here ...and my computer
should be packed by then and I'm posting .

Law has lots of loopholes and I don't think I'll ever understand it. All I know is that I'd be plain disgusted if they decide to make tab sites like powertabs.net and my songbook.com illegal. If so, then even this foro would be restricted in terms of what we post.

All that I'm concerned with, is that tabs on such sites are the tabber's interpretion and it's just ridiculous to restrict such uploads/downloads.

I was thinking the same thing. More specific details as to the reason the website was shut down should help to clear up alot of the misplaced concern.??

I just spoke to one of the administrators of the powertabs.net website. He says that users uploading and downloading tabbed "interpretations" of songs is strictly speaking NOT illegal.
HOWEVER, the industry officials are objecting to the fact that some website members copy tabs directly from official song books and apparently this IS illegal.
The problem is that it is virtually impossible to proove whether a tabbed song is an "interpretation" or a copy, and so the authorities are playing heavy-handed tactics and attempting to shut down ALL the major tab sites on the basis that there is a distinct possibility that SOME of their tabs might be illegal copies.
From what I understand it is the main tab websites (such as powertabs.net and mysongbook.com) that supply THOUSANDS of tabs that will be the focus of the industry's legal action. But I'm guessing that websites that literally only provide tabs for songs WITHOUT official tab books might escape prosecution (or thats what I'm hoping!). But there aren't many of those, and its usually the bigger tab websites that have most choice.
The powertabs.net administrator has assured me that they will try and get the website back up and running when some of the heat dies down. But if the authorities are as intent on this crackdown as is implied, I would suggest downloading and saving as many of the tab files you want as possible whilst they are still available.

you should be careful about how you view these lawsuits. As ridiculous as they sound, there is more to them than meets the eye.

My wife is a successful lawyer and I see the other side, the side that doesn't get exposed by the big-time media or constantly trumpeted on insurance company commercials, and it's a whole other world.

The lawsuits for fat people and for the lady who got burned are not, per se, about taking responsibility for eating too much or being clumsy with the coffee. They are about despicable actions of the companies that were turned up by the lawsuits.

For example, in the old McDonalds/coffee lawsuit, it was shown that they kept the coffee at a temperature far above what was drinkable. The reason was so that people wouldn't drink the coffee in the store and get refills--although refills were offered. Is this illegal? No... just tricky and a bit dishonest. The problem is they found that hundreds of people were severely burned by the coffee (accidents happen). McDonalds knew about this, but they refused to change the temperature.

When the jury found out about how many people were injured by the practice of keeping the coffee unconscionably hot, they were so outraged (remember, these are ordinary people sitting on the jury), that they slapped McD's with huge punitive damages! Punitive damages are meant to discourage a transgressor from illegal and malicious action ("evil mind" is the standard), not reward little old ladies for their clumsiness. This widely publicized award, $100 million or something, was reduced by a huge amount in the extensive appeal process. Probably the old lady died before seeing a penny...

The Ford Pinto case, you may recall, was somewhat similiar. Ford knew there was a flaw in their cars, and they it would case a certain amount of people to be killed. They calculated how much they would have to pay out in wrongful death claims. This is all documentd in internal communications. The problem is that during the lawsuit, this all came out, and again, it was shown they had "evil mind" and got slapped with punitive damages.

The fast food case is not so cut and dried, although personally I am for it. Not because I have any particular sympathy toward uncontrolled eating. However, fast food is basically poisonous and our food system in the US is set up so that it is very difficult to avoid. Like Joe Camel advertising toward kids, most fast food commercials are aimed at little 'uns who have no real knowledge or defense against it. Not that most people really have a good defense against advertising. Fast food is also aimed at low income people who are short on education and often transportation. The end result of fast food is what you see waddling around every street in America.

If you think we are fat over here because as a race we lack discipline or intelligence, then I think you are being a little harsh. I would not be sad at all, if McDonalds and Burger King, etc., got slapped down and had to serve only food that met a certain level of decency. If one of these lawsuits does it, then I'm all for it. I'm not too sympathetic to drug dealers, cigarrette companies, or fast food sellers--all purveyors of poison.

Hold on guys... I think my last post may have been inaccurate! I think it might also illegal to make "interpretations" of songs. I did some research on the authority that is actually taking the legal action- the MPA (music publishing association).

This exerpt was take from the www.mpa.org website under their FAQ section:

6. Do I need permission to make an arrangement or transcription?
If an arrangement is made of a copyrighted work without the authorization of the copyright owner, the arrangement would be an unauthorized derivative work and therefore an infringement of the copyright and the exclusive right of the copyright owner. The first thing to do when you want to make an arrangement is check if the work is in the public domain or if it is protected by copyright. If the work is protected by copyright, you cannot make an arangement without the prior permission of the copyright owner.


Does that make sense? I think that means it is ILLEGAL!

I can't speak for their habits across the pond, but over here they have started making a real effort to clean up their act. They have launched a range of healthy salads and sandwiches, as well as fruit, juices and milk. Its not perfect, but its a step in the right direction.

Miguel,

Thank you for your elaborate response! Your points are well taken. However, I do believe that many people in North America exploit the system by not accepting responsibility for their own actions in order to make some money in the process. This, I also believe, is becoming a trend for various reasons I don't want to get into now.

It may not be a lack of intelligence, but it is definitely a lack of education and descipline. This thing is slowly degenerating into a philosophical squabble about life in general.
Scottish kids were deemed by a recent survey to be the most obese kids in the world, due to a high intake of chips and junk food.
But when I walk around town I don't see them?
I'm 5ft 9" and 140lbs...
All the kids I see are normal and healthy...

Where do they get all this data from?

Like lots of Europeans imagine the stereotypical American as 6ft, 300lbs, with pearly white teeth, glasses and a beer gut hanging over plaid shorts and a camera hanging over his money belt, saying in a Southern drawl "Gee, honey..here we are in Paris, France!"
All not true of course, but everybody enjoys National Lampoon.

All members of this Forum live basically in the same sort of world now..

Personally, I , being much older than a lot of you, was never brought up to think that anything was free.
I now have to listen night after night to TV commercials, telling me that I'm sad, not tuned in, or to stupid to buy their latest product.
Folk under 30 have been brought up with this crap.
Hence things like Napster and behaving like everything should be free etc.
I think this philosophy has a "carry on" effect into other areas, like guitar, where one might say.."Hey..I've bought all these Encuentro Videos and two years later I still sound like crap....what gives here?"

Ive heard that too about the scottish kids.

Regarding Donald Trump: He can pay someone to teach him or play for him 24h a day, 400 days a year... Yes Donald Trump can even make a year last 400 days


To topic: Im not happy about it, but the fact is, for one year im not using transscriptions that much. Only look at chords and positions.
I was never a "sheet"-musician and also never liked the idea, honestly.
Lets hope, that all the people who were dependent on tabs use their ears more often now. Its the best way imo.

hey ....but with that kind of money ...he could persuade someone to write book
like "Learn flamenco in 24 hours"

Anyway ...in short time I'll have the tabs to play for a lifetime .I think I already
have tabs for twenty years.I'm not scared.

But even if they succeed in stopping it ,they cant stop file sharing.This
will be a never ending battle....they just cant stop it ,the comunication techniques
are developing way too fast.They can not stop the information to go around,
but they can however stop u from using it for comercial purposes.

there are tons of music available on any DC++ hub...this will take like
ages.Anyway , we'll still have live concerts ...and u cant fake that.
