shipping back a guitar for repair

Dear All,

I would like to ask you guys if any one of you face this issue,

I will send a guitar that I order from spain back for repair,

the guitar was broken during shipping , and after a long process and so many meeting with the shipping company they offer me a disscount for shipping the guitar the two way for repair,

the supplier is asking me if there is a tax when he recives the guitar? any idea guys!!

the shipper should pay for shipping and the cost of the repair. After all, they broke it!

There will be a tax and that is why you should declare the value of the guitar at a very low value.

If the guitar was packed properly by the shop/builder for transport and you received it broken the shipping company has got full responsability for both shipping and repaircosts! They should also know about the tax.
If I were you I´d contact again with the shipping company to make sure you don´t have to pay anything because it wasn´t your fault the guitar broke during transport.

Good Luck and don´t accept no for an answer!

Wouldn't that also mean it gets insured for less?

May I ask which shipping company?

Don't declare less value, it must be insured for full price because the Shipper should pay for everything if they concede the damage was done by them during shipping. You or the shipping company may have to pay sales tax on the repair work, but not the actual value of the guitar. You should only pay the import tax to your own country ONCE and not a Re-Import tax to enter or exit Spain. Nor should pay another entry sales tax to your country after the repair work is complete. Check with your countries customs dept get a sales tax waiver form of some type. The guitar is not being sold. Contact the Customs dept of Spain to find out which papers should be accompany the guitar. This is not a sales transaction and is the same as taking the guitar in and out of the country like a tourist. Sales tax does not apply.

It is very important that you place the same value on the shipping insurance as the value declared when the guitar was shipped to you. If the value shows an increase after leaving Spain they can tax you for the value increase.

This is from Ireland, but outlines EU regulations on 'Re Importing Goods'- According to EU regulations re-import VAT may not apply ,but check Spain Customs in EU regulatoins regarding VAT and Customs. Read Section #4

With the right papers you probably will not have to pay. The shipper should provide the forms, but if they don't you should check yourself.
